The Kitchen Remodeling Contract

Introduction

This contract was drafted by (*name of subcontractor and their address) (subcontractor), among (*name of general contractor and their address) (general contractor) and (*name of the homeowner and their address) (homeowner). Collectively, they will be addressed as “parties” and “party” individually.

All parties involved shall only sign this contract upon reading, understanding, and agreeing to the following terms:

Scope of Services

The subcontractor shall perform the following activities within the kitchen as called upon by the general contractor most efficiently and effectively possible:

  • Replace old water pipes and taps with the recommended ones.
  • Restore and upholster the sinks, countertops alongside the walls, and the kitchen island.
  • Dismantling the floor and replace it with the preferred flooring material.

Time

The subcontractor will begin working upon official engagement with the general contractor by signing this contract. The service delivery will take approximately seven weeks, considering all other work factors like changes, days off, and delays. Any adjustments to the schedule shall be discussed and made by both parties. The final determination on time shall be upon the general contractor. Failure to heed to contractual engagements shall warrant initiation of Alternative Dispute Resolution mechanisms before the court process is applied.

Payment

The general contractor will make an initial payment of 50% of the entire budgeted work’s total cost. The general contractor will make a subsequent payment of 25% upon completing 75% of the scheduled work. The remaining 25% will be due following the completion of the entire work agreed upon. All payments will be by a bankers’ cheque issued by the general contractor.

Contingencies and Additional Work

Any charges accruing from additional work outside the scope shall be accounted for by the general contractor. Contingency plans have to be in place in case of any emergency for them to be readily actioned. Satisfactory performance shall be based on agreed quality standards predetermined at the contractual phase. In case of a disagreement, the basis for resolution shall be an objective test without unduly favoring either party. If any of the parties deems it necessary to make changes on time, payment, or the work for any reason, they should timely present their request to the other parties. Recommended actions shall then be addressed accordingly by the parties.

Contractor Engagement

The subcontractor shall be responsible for maintaining the scope of work aforementioned. All labor necessary to see the work through shall be hired by the general contractor and not the subcontractor. If there are any recommendations the subcontractor may wish to make, they may leave the general contractor’s final decision. Only the general contractor shall be responsible for engaging the subcontractor and, therefore, also answerable for payments and defining the scope. The general contractor shall be liable to the homeowner for the subcontractor’s actions.

Requirements and Permits

The general contractor shall be in charge of bringing the subcontractor up to speed with requests and requirements necessary for work performance. Additionally, together with the homeowner, they will be expected to disclose details about the work premises, including any dangers that may be encountered. All parties shall officially present all permits and licenses before the project’s commencement. The subcontractor shall also bring to the general contractor’s attention any issue or deficit that may harbor work delivery at any stage.

Termination

This contract may be terminated upon any reasonable cause presented by the subcontractor, general contractor, or homeowner via the general contractor. The cancellation shall be in writing to be read, understood, agreed, and signed by all parties. All pending responsibilities shall be addressed within five working days after the request to terminate operations.

Conclusion

This contract is a legally binding document for all parties involved upon agreement and signing. All parties shall be in agreement and sign out of their free will (Muthalib, 2018). Each party is expected to act according to this contract’s requirements and agree to that in signing in their respective space below.
