Procedural Law in Business

Procedural law is a set of legal norms regulating the procedural order procedures for the practical implementation and enforcement of substantive law. Procedural law is inextricably linked with substantive law, as it establishes the procedural forms necessary for its performance and protection (Rammeloo, 2019). There are the following primary forms of judicial process: constitutional, civil, criminal, administrative. It can be recognized by the word process in the name of the procedural source of law.

In this matter, other interested people who may suffer from incorrect management decisions may be the company’s customers. Low and continuing to decline productivity can damage the affairs of the company’s partners, which can lead to large-scale problems for the entire enterprise. The consequences of the first option will have a significant negative impact on the company’s rating, as internal issues affect production efficiency. Customers may suffer that the company’s employees cannot come to a joint decision and appoint a manager, which makes it impossible to establish production and maintain partnerships.

The consequences of the second option will cause minor damage to customer relationships. This is because the issue will be resolved internally and will not affect the efficiency of the production process. In addition, this option will allow maintaining relationships in the team and will enable finding for each employee who is striving for promotion the most suitable choice for career advancement. Since the management staff will solve work issues together with subordinates, the company will retain customers and avoid any procedural disputes.

The critical moment of making a decision is the appointment that Rose will have to make. Suppose she chooses the first option in which she and Andy privately discuss the position of a manager and do not give other successful co-workers a chance to be promoted. In that case, this may negatively affect the company’s productivity. Consequently, this can lead to negative consequences with customers and will also bring discord directly into the team itself. When choosing the second solution to the problem, it is also necessary to consider the desire of other employees to grow up the career ladder and allow them to occupy different leadership positions in the company.

Different lessons can be learned from these events, for example, how important it is to consider each team member’s opinion when making management decisions. In addition, it is necessary to consider that incorrect decisions can become a threat to the success and productivity of the company and subsequently bring negative results of cooperation with customers. Procedural justice can cloud the business climate, and procedural justice can hurt the further success of the enterprise (Dominic et al., 2021). Moreover, procedural justice can restrain entrepreneurial activity, negatively affect predictability, increase risks, and inhibit the growth of the private sector. The justice system unduly hinders the development of micro, small and medium-sized enterprises because they have fewer means to cope with this problem, which can become a decisive factor in the very existence of their enterprises.

The balance of flexibility and business response to changing circumstances is achieved by making the right decisions by management, considering the internal needs of the company. And, this symbiosis can be achieved taking into account the consequences that may affect the performance of the company and customers. In addition, the business should be based on fairness about each element of business processes (Antunes et al., 2019). Management personnel can combine flexibility, respond quickly and promptly to changing circumstances and conduct business by appropriate methods that make the company successful and set it apart from other similar ones.
