Sexual Behavior with Minors: Responsibility for Crimes

Two Ethical Theories

The case should be taken on trial on the Rape 3rd charges and DWI (Driving While Intoxicated). This is based on two ethical issues. The theory of utilitarianism claims that the moral value of a certain act is dependent on the results it causes. It rules out that there should be greatest good for a large number of people. Therefore when someone commits an act in the society one should consider the outcome of their acts. The woman should be concerned of the feelings of the parents of the boys she rapes. There is also concern in that the boys involved could contract sexually transmitted disease so their future lives are ruined. This is because the woman has intercourse with many people. The issue of DWI should also be subjected to law according to this theory is because it may lead to road accident which could kill many people. Ethical egoism claims that people act in their own self interest but they should not harm the well being and the interests of others. The woman meets her self-interest in raping boys and drinking but as a result she is harming the lives of the boys and may involve other people in road accidents.

Discipline of victimology and its sub-categories in justification

Victimology is the study of how the victims of crime are responsible for following victims of certain crimes. There are three categories which includes; victim blaming where the victims are fully to blame for the crime. The boys seemed to enjoy themselves. This means that they might even heave seduced the woman into having sexual intercourse with them. The boys seemed to be proud of their relationship with a far much older woman. Another category is victimization which is referred to as abusing others. The woman in question is victimizing the boys and abusing them since they are underage. She also abuses alcohol since she drinks while driving. There is also victim playing where manipulators put themselves at a state needing sympathy. The woman may be seeking pity from the boys and so they get themselves being victims of abuse.

Legal moralism and paradigm of law

According to legal moralism there is every right to judge a behavior that is taken as immoral by the society. It is collectively accepted by the society that the behavior is immoral and the district attorney should proceed with the case. Having such sexual behavior with underage persons is condemned in the society. Legal moralism therefore justifies that the woman should be put under justice because the parents of the boys wants justice to be done. The woman involved comes from a higher class and is using her social status to entice the boys into her sexual interests. The woman works at the school where the boys learn and so she is taking advantage of her authority. Paradigm of law involves the laws and policies enacted by a state to maintain law and order and to protect the rights of individuals. The law of the country states that it is Rape 3rd to have sexual behavior with someone is under the age of 17, if the person involved is older than 21. This is the law that applies in the New York State Law so as to protect the rights of persons under the age of 17 from being abused by older persons. Therefore justice should be sought according to the state law. The case of DWI is also illegal according to law and hence the wo0man should face trial for her crimes.
