The Café Bar’s Employee Relations: Illegal Substance and Alcohol Use

Purpose

The Café Bar is committed to offering and preserving a secure and prolific work atmosphere, liberated from the unfavorable consequences of drugs and alcohol. As such employees who report to work having used or whilst weakened by drugs or alcohol can be a security risk to themselves and others, as they could make blunders that can be critical to themselves as well as to their colleagues. This policy concerns each and every member of staff and contender for employment with the cafe.

Definitions

Illegal Controlled Substances are drugs that are not lawfully accessible and drugs which are officially accessible but have been attained illegitimately or are misused. Reasonable Cause is a rational fine faith objective doubt on the part of the administration that a member of staff has consumed drugs or alcohol before reporting to service or is weakened by drugs or alcohol. Reasonable Cause can be based upon a staff’s performance at work, manifestation or demeanor, together with any of the following including Odor of alcohol or another intoxicant about the employee or on the employee’s breath; Unusual impairment in speech including faltering, weaving, or other loss of motor coordination; Inexplicable animated signs of intoxication or influence of drugs on the part of the employee; Custody of alcohol, drugs or associated supplies;

Policy Statement

  1. It is obligatory for employees to report to work in a mental and physical state that permits them to work carefully and efficiently and as such the employees are forbidden from working on Café bar campus, working any apparatus, or entering into the Café at any time after using or while impaired by drugs or alcohol.
  2. The use of drugs attained by recommendation in a way permitted by the recommending physician is acceptable, provided that the user does not impair secure and useful job performance. An employee undertaking approved remedial treatment with any drug or prohibited material that impairs his or her capacity to work safely must instantaneously account this to the administrator.
  3. The utility, consumption, production, ownership, trade, circulation, or transfer of alcohol, mind or behavior changing matter, Illegal Controlled Substances, the possession of associated belongings, or the mishandling of remedial drugs by an employee while at work is strictly prohibited.

Testing

The café necessitates drug and alcohol tests in situations when there is rational ground to believe that an employee is at work after having used or while impaired by drugs or alcohol and as such random testing will be conducted where permissible by applicable law. An employee’s person and personal property on the café premises shall be scrutinized if there is Reasonable Cause to suppose that the policy has been dishonored and such property may contain prohibited substances or associated paraphernalia. Any evidence that is found will be seized. If the substance seized is believed to be an Illegal Controlled Substance, law enforcement authorities will be contacted and arrangements will be made to transfer the suspected Illegal Controlled Substance to law enforcement authorities.

Disciplinary Action

Violation of any of the situations outlined below will also result in disciplinary action up to and including discharge:

The use, consumption, production, custody, trade, circulation, or transfer of alcohol, mind or behavior-altering substances, Illegal Controlled Substances, or custody of related supplies whilst on the café premises; or the use of drugs acquired by a remedy in conduct not permitted by the recommending general practitioner; or the denial to take a drug or alcohol test, denial to assent to a search, denial to sign an agreement for making public of test results to the cafe, efforts to hinder the testing procedure; or certainty of a crime related to drugs, which takes place at the cafe.
