This paper examines the issue of the human right to equality and non-discrimination, which is in question in the United States. Most probably, this right implementation is likely to achieve the most criticism from other nations of the world during the Universal Periodic Review. As the UN report from 2015 states, “CERD recommended that the United States adopt a national action plan to combat structural racial discrimination” (UN Human Rights Council, 2015, p.4). According to the report, race-related issues were present in law enforcement and the administration of justice, court practice, and everyday life (UN Human Rights Council, 2015, p. 6). The report focuses on racial inequalities in African Americans.
According to the US Census Bureau, the proportion of black people in the country is about 13%, and in numerical terms, no more than 50 million people (“Quick facts United States”, 2020). Every day, this ethnic community is faced with a variety of difficulties – from the forced adaptation to changing their behavior among white representatives and the injustice of the US criminal system towards African Americans. The African American problem has remained unnoticed over the past decade by the Trump Administration, which is the reason why representatives of this ethnic group continue to experience racial discrimination not only from society but also from the state.
Currently, the death of George Floyd has led to massive protests against racism in the United States. In addition, statistics show that there are still serious racial discrimination problems in American society (Horowitz et al., 2020). The direction towards which the United States should aim can be called racial democracy that is characterized by a situation in which racial diversity exists, but racially determined social inequality is absent.
